Wiper Party leader Kalonzo Musyoka has welcomed a Court of Appeal decision declining the government’s application to suspend High Court orders that declared the proposed sale of Safaricom shares null and void.

In a statement issued from London on Tuesday, October 13, 2026, Kalonzo said the appellate court’s decision meant the High Court orders issued on September 15, 2026, would remain in force as the substantive appeal proceeds.

Kalonzo, who represents petitioners led by Tony Gachoka and others in the case, said he attended the virtual court proceedings from London, where he is currently on official engagements.

The Court of Appeal bench, comprising Justices Kimaru, Okello and M’Inoti, declined the government’s application for a stay of the High Court orders.

“The message is clear: the rule of law must prevail, and no transaction involving our national assets is above constitutional scrutiny,” Kalonzo said.

He maintained that the country’s strategic assets should be protected through constitutional safeguards, insisting that decisions concerning them must be guided by the law rather than the interests of those in power.

“Our national assets belong to the people of Kenya. Their future must be determined by the Constitution and the law, not by the convenience of those in power,” he added.

The latest development means the High Court orders remain in force for now, although the substantive appeal process is yet to be concluded.

Kalonzo takes Kenya’s opposition agenda to London

Beyond the court proceedings, Kalonzo is using his London visit to advance his political and economic agenda ahead of the August 10, 2027 General Election.

On Monday evening, the former Vice President said he delivered a keynote address at the House of Commons to the Westminster Africa Business Group in partnership with the Eastern Africa Association.

He was also scheduled to address Chatham House on Tuesday on the topic, “The Opposition’s Outlook and Policy Agenda on the Road to the 10 August 2027 General Election.”

Kalonzo said his address would outline his vision for a Kenya anchored in constitutionalism, accountable leadership, economic justice and the protection of national interests.

The Wiper leader has positioned the protection of public assets and adherence to the Constitution as central themes of his political message as opposition leaders prepare for the next General Election.

He concluded his statement with a call for national interests to take precedence in public decision-making.

“Kenya must come first. The Constitution must stand. The people must prevail,” he said.
