City lawyer Benard Odero Okello has been apprehended after the Office of the Director of Public Prosecutions (ODPP) directed police to charge him over forged documents presented before the Employment and Labour Relations Court.
The Directorate of Criminal Investigations (DCI) said Odero, of Benard Odero & Company Advocates, was apprehended at his office at The Westery building in Westlands, Nairobi.
The move followed investigations into a complaint filed by three officials of the Kenya County Government Workers Union, Nairobi Branch, over documents presented in Nairobi ELRC Cause No. E068 of 2022.
According to the DCI, Odero presented a Change of Signatory & Fee Note Agreement purporting to have been signed by the three complainants.
The agreement, the DCI said, indicated that Odero was to receive Sh150 million upon conclusion of a case in which he claimed to have represented the officials.
The three officials disputed signing or executing the agreement.
The disputed documents and specimens of their known signatures were subsequently submitted to a forensic document examiner.
The DCI said the forensic examination confirmed that the documents presented before the court were forged, backing the complainants’ position that the signatures appearing on the documents were not theirs.
DCI adds assault charge
Following the investigations, the DCI said a directive was issued on September 2, 2026, for Odero to be charged with two counts of forgery and uttering a false document.
Odero was summoned to present himself at Parklands Police Station but, according to the DCI, failed to do so.
Police subsequently launched a search for him and traced him to his Westlands office.
The DCI said Odero then threatened to jump from the eighth-floor window of the building in an attempt to evade being apprehended.
Officers eventually apprehended him.
But according to the DCI, Odero bit two police officers who were attempting to restrain him.
The incident has now added more charges to the case.
The DCI said Odero will also face charges of resisting apprehension and assaulting police officers, in addition to the forgery-related charges already approved.
The case will now proceed through the criminal justice process, where the charges will be presented before court.
